1. Agreement to These Terms
These Terms of Service (the "Terms") govern your access to and use of services provided by Bloomview Growth ("we," "us," "our"), including our website at bloomviewgrowth.com, our lead-generation and AI-installation services, and any related communications or deliverables (collectively, the "Services").
By submitting a form, booking a call, signing an engagement letter, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Who We Are
Bloomview Growth is a marketing and AI-installation agency operating in the United States. We work primarily with home-service operators (roofing, HVAC, plumbing, cleaning, electrical, landscaping, and similar trades) to grow their revenue through Google ranking, AI automation, and operational systems.
You can reach us at dylan@bloomviewgrowth.com.
3. What We Do (Services Offered)
Our Services may include any combination of the following, as specified in a separate engagement letter, statement of work, or written agreement (each, an "Engagement"):
- Local SEO — Google Business Profile optimization, citation building, review-velocity campaigns, on-page content, and Google Map Pack ranking.
- AI installation — deploying AI agents on your workflow for inbound call answering, estimate follow-up, review requests, scheduling, and similar customer-facing automations.
- Website builds and conversion optimization — building, redesigning, or optimizing your website for lead capture.
- Done-with-you onboarding — on-site visits, team training, and direct workflow installation as specified in your Engagement.
- Free resources — playbooks, guides, case studies, and educational content available on our website.
The exact scope, deliverables, timeline, and pricing of an Engagement are documented in the separate written agreement we sign together. These Terms apply on top of that agreement; if there's a conflict between these Terms and your Engagement, your Engagement controls.
4. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract on behalf of yourself or your business. If you're entering an Engagement on behalf of a company, you represent that you have authority to bind that company.
5. Fees, Billing, and the 90-Day Guarantee
5.1 Pricing
All Engagements are priced in U.S. dollars and billed monthly, unless otherwise stated in writing. Specific fees, payment frequency, and any one-time setup costs are documented in your Engagement.
5.2 Month-to-month terms
Unless otherwise agreed in writing, our Engagements are month-to-month. There are no long-term contracts. You can cancel for any reason with written notice (see Section 12).
5.3 The 90-day guarantee
Our promise: if we don't deliver measurable progress against the goals agreed in your Engagement within 90 days of your start date, you don't pay for those 90 days. Any fees paid for that period are refunded in full.
The guarantee is subject to these conditions, which exist so the work has a real chance to produce results:
- You provide reasonable access (Google Business Profile admin, website admin, CRM exports, team availability for installation, etc.) as required by the Engagement.
- You don't materially change scope, pause work, or block deliverables on your side.
- You communicate in good faith and respond to our requests within a reasonable time.
- You are an eligible business under Section 4.
- The goals being measured are those documented in writing in your Engagement — not aspirational outcomes not specified there.
If you meet the conditions above and we fail to deliver the specified outcome by day 90, we'll refund the prior 90 days of fees in full. The guarantee does not refund expenses paid to third-party services on your behalf (e.g., ad spend, software subscriptions, hosting), which remain payable.
5.4 Late payments
Invoices are due upon receipt unless otherwise stated. If an invoice is more than 30 days past due, we may pause work without prior notice. If more than 60 days past due, we may terminate the Engagement and demand immediate payment of all amounts owed.
5.5 First month free for Local SEO
Where specifically offered (e.g., on certain advertising creatives or campaigns), the "first month free" applies only to the recurring Local SEO service fee for the first calendar month of work. It does not apply to one-time setup fees, ad spend, third-party software costs, or services outside Local SEO. The offer is available only to new Engagements and only once per client.
6. Your Responsibilities
To get results, we need you to:
- Provide accurate and complete information about your business.
- Grant the technical access we ask for (admin on Google Business Profile, website admin, social profiles, CRM exports, payment system reports, etc.) as needed.
- Make team members available for installation/onboarding meetings and respond to messages in a reasonable time.
- Comply with the laws and platform rules that apply to your business (advertising regulations, FTC endorsement guidelines, your state's consumer-protection laws, Meta/Google/Yelp/etc. platform terms).
- Pay invoices on time.
- Not use our work to engage in fraud, deceptive practices, harassment, or activity prohibited by law.
7. Ownership of Work and Data
You keep everything. All deliverables we create specifically for you under an Engagement — website code, content, AI agent configurations, Google Business Profile optimizations, ad creatives — become your property once we've delivered them and you've paid for them. If you cancel, you keep all delivered work.
What you do not get ownership of:
- Our proprietary methodologies, frameworks, playbooks, and internal tooling (including the systems described in any free resources we publish).
- Third-party software, models, or tools we use (which remain owned by their respective providers).
- Pre-existing materials we license to you for the duration of your Engagement and which revert at the end.
You grant us a non-exclusive, royalty-free license to use, store, and reference your business name, logo, and aggregated performance results (e.g., "we grew Client X from $1.2M to $1.83M") for our own marketing, unless you ask us in writing not to. We will never share individually identifying confidential information (e.g., customer lists, contract terms) for marketing without your written consent.
8. Confidentiality
Each of us may share confidential information with the other during the Engagement — customer lists, pricing, strategies, financials, vendor agreements, internal documents, and similar non-public information. We each agree to keep the other's confidential information confidential, use it only for the purposes of the Engagement, and protect it with at least the same care we use for our own confidential information.
This obligation survives termination of the Engagement.
9. Performance Disclaimers
Results vary. Past client outcomes (including any specific dollar amounts, ranking improvements, or revenue figures cited on our website or in marketing) are real but not typical or guaranteed. Marketing results depend on factors outside our control, including your market, your team's execution, seasonality, ad-platform algorithm changes, competitive response, and your own operational follow-through.
Statements about revenue, lead generation, or business growth on our website or in our marketing materials are illustrative, not promises of similar future outcomes for you. Your results depend on the work you put in alongside ours.
We are not affiliated with Google, Meta (Facebook/Instagram), TikTok, YouTube, or any other platform mentioned on our website. Our Services use these platforms but are not endorsed by them.
10. Limitation of Liability
To the maximum extent permitted by law:
- Bloomview Growth is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, even if we've been advised of the possibility of those damages.
- Our total liability to you for any claim arising out of or relating to these Terms or the Services is limited to the total amount you've paid us in the three (3) months preceding the event giving rise to the claim, or $1,000, whichever is greater.
- This limitation applies whether the claim is based in contract, tort (including negligence), strict liability, or any other legal theory.
Some jurisdictions don't allow exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Bloomview Growth and its officers, employees, contractors, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of:
- Your use of the Services in violation of these Terms or applicable law;
- Your business operations, products, or services (including any claims about quality, safety, or fitness brought by your customers);
- Your violation of any third party's rights, including intellectual property or privacy rights;
- Content or materials you provide to us or instruct us to use, post, or publish.
12. Cancellation and Termination
By you: You can cancel your Engagement at any time with written notice to dylan@bloomviewgrowth.com. Cancellation is effective at the end of your current billing month unless your Engagement specifies otherwise.
By us: We may terminate your Engagement with written notice if you breach these Terms or your Engagement and don't fix the breach within 14 days of our notice, if your payment is more than 60 days past due, or if continued service would expose us to legal or reputational risk.
Effect of termination: Outstanding payments through the termination date are due immediately. We'll deliver any work already completed. The sections of these Terms that by their nature should survive — ownership (7), confidentiality (8), disclaimers (9), liability (10), indemnification (11), governing law (15) — survive termination.
13. Third-Party Services
Our Services rely on third-party platforms and tools, including Google, Meta, Cal.com, Hostinger, Railway, Twilio, Stripe, Wistia, and others. We're not responsible for the performance, availability, terms, or pricing changes of those third parties. If a third party changes its terms, increases fees, or becomes unavailable, we'll communicate it to you, but the cost or impact may be passed through to you.
Your use of third-party services is governed by their respective terms and privacy policies.
14. Changes to These Terms
We may update these Terms from time to time. The current version is always at bloomviewgrowth.com/terms with the "Last updated" date at the top. If we make a material change, we'll notify active clients by email or in your Engagement portal at least 14 days before it takes effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved as follows:
- Informal resolution first. You agree to contact us at dylan@bloomviewgrowth.com and try to resolve the dispute in good faith for at least 30 days before initiating any formal proceeding.
- Then arbitration. If the dispute isn't resolved within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be held in or near Hudson County, New Jersey, conducted by a single arbitrator, in English. The arbitrator's decision is final and may be enforced in any court of competent jurisdiction.
- No class actions. Disputes will be resolved on an individual basis. You and we both waive any right to participate in a class action, class arbitration, or representative proceeding.
- Exceptions. Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

The short version: we work month-to-month with no long-term contracts. You own everything we build for you. We'll give you our best, and if we don't deliver against the goals in your written Engagement in 90 days, you don't pay. Results aren't guaranteed and depend on factors outside any single party's control. Disputes get worked out informally first, then by arbitration in New Jersey if needed. We use Google, Meta, and other platforms but aren't affiliated with them.
